IP 360 recently published a list of the 5 top trade secrets developments in 2021, and #3 on the list was a decision in favor of MKW client Beauty Barrage. The decision by the Superior Court in San Francisco denied Defendants’ attempt to dismiss while enunciating the criteria for determining “threatened misappropriation” of trade secrets. The Court found the complaint, when properly analyzed under the criteria, alleged sufficient facts to support the claim. Beauty Barrage was represented by partners Rory Radding, Marc Pernick, Hui Liu, Sherman Kahn and Jason Bartlett with legal assistance from Emily Sullenberger and Chizuru Kirigakubo.
